Specialist Fátima Silva harshly questioned the judicial action in the death of the 4-year-old boy in Comodoro Rivadavia and maintained that an “ideological decision” prevailed over the best interests of the child.

Amid the shock over the death of Ángel López, the 4-year-old boy who died in Comodoro Rivadavia, criticism of the actions of Family Justice is growing. In this context, renowned lawyer Fátima Silva issued a harsh warning: “Gender ideology came to destroy the family.”

With more than 36 years of experience, the specialist pointed out what she considers to be a repeated pattern in cases such as that of Ángel and that of Lucio Dupuy, and she assured that judicial decisions do not respond to legal criteria but to an ideological perspective.

For Silva, the starting point is clear: “There is not much to legally understand in this case, because the resolution was not legal, but ideological.” In this regard, he argued that Justice prioritized that the child live with his mother, Mariela Altamirano, without thoroughly evaluating the conditions of each family environment. “Ideology clearly prevailed,” he remarked, while questioning the reconnection process: “The little boy was moved out of college, as if it were one thing,” he described

One of the toughest questions was addressed to Judge Pablo José Pérez, who intervened in the case and decided to return the child to his mother. “The judge didn't hear or see him,” Silva said, adding: “He treated this four-year-old boy like a package and left him to his own devices.” According to the lawyer, there is a structural problem: “They can act as they can think of... they are not going to be sanctioned

,” she said.

Silva went further and questioned the application of the so-called gender perspective in these cases:
“It's not perspective, it's gender ideology,” she said. And he launched a strong definition: “In gender ideology, women are always right and everything they say must be believed.” For the specialist, this ends up directly affecting minors: “We are dangerously trapped by ideologized justice, children are

dangerously trapped”.

Another critical point mentioned was the absence of follow-up by the institutions. “Nobody monitored Ángel,” he said, and detailed worrying situations: “He was dirty, without bathing and even hungry.” He even said that a mother from the school environment had to assist him: “She had to buy him a sandwich because she looked at the food with desperation.” For Silva, this exposes a structural failure in child protection systems

The lawyer also questioned the weight of technical reports in this type of decision: “The judge stuck the hook trusting the psychologist's advice,” she said. And he warned: “In practice, they make them binding in fact because the judge does not know the parties.” This, as he explained, leads to a delegation of functions: “It is delegating jurisdiction and privatizing justice

The Ángel case occurs in a context of cross-complaints of violence between parents, which further complicates the judicial analysis. However, Silva relatized the impact of these accusations: “A complaint between adults does not imply that the father could not care for his child.” In addition, he warned about the misuse of the system: “There are more and more false complaints,” he said, and linked the phenomenon to economic and

political incentives.

For the specialist, the problem is deeper and responds to a structural change in family justice: “Judges have lost their eyes on the law and have forgotten what they were taught in college.” And he concluded with a warning that connects directly with the Ángel case: “If we managed to banish ideology and return to objectivity, many of these deaths

would not have occurred.”
