The National Court annulled a tax sanction against Shakira for the year 2011 and ordered the return of more than 55 million euros along with legal interest.

The Colombian singer Shakira achieved an important legal victory in Spain after the National Court annulled a tax sanction corresponding to the 2011 fiscal year and ordered the refund of more than 55 million euros, in addition to the accumulated legal interest.

The decision represents one of the most significant rulings in the extensive dispute between the artist and the Spanish Tax Agency regarding her tax residency during the years she was in a relationship with former footballer Gerard Piqué.

The Justice concluded that Shakira did not reside long enough in Spain

The central issue of the conflict was to determine whether the singer should be taxed in Spain for her global income during 2011.

Spanish legislation establishes that a person is considered a tax resident when they stay in the country for more than 183 days a year.

However, the court concluded that the Spanish authorities only managed to prove Shakira's presence in Spanish territory for 163 days, insufficient to consider her a tax resident.

For that reason, the National Court ruled:

  • to annul the settlement made by the Tax Agency

  • to refund the amounts collected

  • to add legal interest on the withheld money

The refund exceeds 55 million euros, equivalent to more than 64 million dollars.

Shakira's tax conflict in Spain

Shakira's legal troubles with the Tax Agency began years ago and were mainly linked to her international movements and her residency between the Bahamas and Barcelona.

The artist always maintained that:

  • she permanently settled in Barcelona only at the end of 2014

  • she officially transferred her tax residency in 2015

  • during the previous years she continued living and working outside of Spain

  • The Spanish Justice, on the other hand, considered that she was already residing in the country during part of that period and that she should pay taxes on income earned worldwide.

    The agreement that avoided a trial in 2023

    In November 2023, Shakira had already reached an agreement with the Spanish prosecutor's office to avoid a trial for another case related to taxes from 2012 to 2014.

    At that time:

    • she accepted the charges

    • avoided a prison sentence

    • paid a fine of over 7 million euros

    The original trial was set to include more than 100 witnesses and several weeks of hearings, although it was ultimately resolved in just minutes through a judicial agreement.

    “I wanted to protect my children”

    After that agreement, the singer publicly explained that she made the decision to avoid personal and family strain.

    “I had two options: to keep fighting until the end or to close this chapter and look forward,” she expressed.

    She also stated that her children asked her to avoid a prolonged legal process.

    The new ruling can still be appealed

    Although the ruling represents an important victory for the artist, the resolution can still be appealed to higher courts.

    In any case, the case marks a significant setback for the Spanish Tax Agency in one of the most high-profile tax cases in recent years.
