Justice ordered the confiscation of Cristina Kirchner's assets in the road case

In a key resolution in the road case, Chamber IV of Federal Cassation confirmed the confiscation of assets provided for in the judgment and ordered to proceed with the execution of the assets linked to the corrupt and convicted Cristina Fernández de Kirchner, her children Máximo and Florencia Kirchner, and businessman Lázaro Báez.

The ruling, adopted by a majority, responds to the fact that assets of illegal origin can be confiscated even if they have been transferred to third parties or received by inheritance.

In this way, the court supported the previous provisions of Federal Oral Court 2 (TOF 2), which had ordered the auction of properties and assets to guarantee the economic recovery established in the conviction.

The amount fixed in the judgment amounts to $684,990,350,139.86, a figure that must be covered by the execution of the confiscated assets.

The measure covers both the personal assets of the convicted and those belonging to companies considered central to the maneuver under investigation, including Austral Construcciones

and other related firms.

In this framework, assets that had been transferred by inheritance to Máximo Kirchner and Florencia Kirchner were also included, reinforcing the view that the illicit origin of the assets prevails over their subsequent transfer.

During the proceedings, the prosecutor before the Cassation Chamber, Mario Villar, argued that those who intend to make a claim about the assets reached must resort to civil or administrative instances, without this implying stopping the execution of the confiscation ordered in the judgment.

The details of the assets involved include a total of 141 properties attributed to Cristina Fernández de Kirchner and Lázaro Báez, including the department located in San José 1111, where the former president is serving house arrest.

In addition, 46 vehicles and various sums of money were counted: USD 4,664,000 corresponding to a safe deposit box in the name of Florencia Kirchner, USD 992,134 in a savings bank of

the Bank of Galicia and another $53,280,24.

For their part, prosecutors Diego Luciani and Sergio Mola insisted on the need to move forward with the execution of the confiscation, stating that “they have not yet deposited a single peso”, despite the fact that the established deadline has expired.} Along the

same lines, they stated that “the resistance they demonstrate shows their total lack of regret and constitutes an affront to the final judgment and to the principle of equality before the law

”.

The conviction of Cristina Kirchner

Cristina Fernández de Kirchner was sentenced in this case to six years in prison and life disqualification from holding public office for the crime of fraudulent administration to the detriment of the public administration

.

Along with her, businessman Lázaro Báez; former Secretary of Public Works José López; former head of National Highway Nelson Periotti; and former Santa Cruz Highway officials Raúl Pavesi, Raúl Osvaldo Daruich, Mauricio Collareda, José Raúl Santibáñez and Juan Carlos Villafañe were also convicted.

With this decision, the Justice advanced in the execution phase of the sentence, focused on realizing the economic recovery derived from the facts investigated in the road case.
