The Democratic leader warns that his party will use its majority in the Senate to block judicial appointments with a conservative orientation pushed by Trump

The Democratic leader Chuck Schumer anticipated that his party will use control of the Senate to prevent Donald Trump from appointing conservative judges to the Supreme Court and promised to block judicial nominations and Cabinet positions that he deems unacceptable.

The Democratic minority leader in the Senate, Chuck Schumer, made it clear that his party intends to use its new parliamentary majority to limit President Donald Trump's ability to transform the federal judiciary, especially the Supreme Court, in a conservative direction. In an interview, the senator from New York stated that Democrats will not allow the president to place a right-wing candidate on the highest court in the country.

''The bottom line is that we are not going to allow a right-winger to reach the Court,'' Schumer declared, who is preparing to regain the position of majority leader when the new Congress takes office in early 2027.

His statements anticipate an institutional confrontation between the White House and the Senate, in which judicial nominations could become one of the main political pressure tools of the opposition. Instead of limiting their objections to the professional background or legal credentials of the candidates, Schumer raised an explicit opposition based on their ideological orientation, stating that a conservative profile would be sufficient reason to generate resistance.

The Democratic leader also warned that his party will not allow the confirmation of ''any mediocre candidate'' for federal courts or presidential cabinet positions. However, he avoided answering whether he would be willing to leave a potential vacancy on the Supreme Court unfilled until after the 2028 presidential elections.

This possibility recalls the strategy used by then-majority Republican leader Mitch McConnell in 2016, when he prevented the Senate from considering the nomination of Merrick Garland, proposed by then-President Barack Obama, arguing that the decision should be left to the next president.

During a post-election press conference, Schumer stated that ''the days of the Senate subordinated to Trump are over.'' He also claimed that Democrats will be willing to support judicial candidates who ''respect the law and the rule of law,'' although he asserted that too many of the nominees put forward by the Republican president do not meet those criteria.

Nevertheless, his promise to prevent a conservative from entering the Supreme Court raises questions about the consistency of that argument. Judicial independence and respect for the rule of law imply evaluating candidates based on their backgrounds, experience, and ability to interpret the Constitution, not simply on whether their ideological positions align with the preferences of the party controlling the Senate.

During his first term, Trump managed to appoint three members of the Supreme Court: Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett. Their confirmations reflected varying levels of bipartisan support: Barrett received only Republican votes, while Kavanaugh garnered support from one Democrat and Gorsuch received three Democratic votes.

In his second term, Trump has already achieved the confirmation of 56 candidates for federal courts, after having appointed over 230 judges during his first presidency. Some of those nominations received Democratic votes, while Republicans also allowed senators from both parties to use the mechanism known as ''blue slip,'' which facilitates blocking judicial candidates linked to certain states.

Currently, there are 28 vacancies in federal courts, making future confirmations a priority for both parties.

Republican Senator John Thune, the current majority leader, highlighted this week that Republicans have managed to place conservative judges in courts across the country at a pace not seen since the Reagan administration. During the summer, he noted that accelerating confirmations was crucial before the midterm elections, as legislators who retire or lose their elections typically stop participating in subsequent sessions.

With a projected Democratic majority of at least 54 seats in the next Congress, although two Senate races are still undecided, Schumer will have greater capacity to influence Trump's judicial decisions.
