The heroic gendarme Nahuel Gallo presented himself as a plaintiff in a case investigating crimes against humanity committed by the Venezuelan narco-terrorist dictator Nicolás Maduro, the regime's highest authority at the time.
The complaint, which is filed with the Argentine Federal Justice, focuses on events that constitute serious violations of human rights, after being kidnapped by the Venezuelan dictatorship.
According to the presentation, sponsored by lawyer Claudio Nuncija and to which La Derecha Diario had access, Gallo presented himself “in his own right” as a “direct victim of the facts under investigation”, asking to be considered as a complainant with all the corresponding legal powers.

The facts reported
In the document, the gendarme Gallo explained that on December 8, 2024, “I was illegitimately deprived of my freedom in the Bolivarian Republic of Venezuela, remaining in that condition until March 2, 2026, the date on which I regained my freedom and returned to the
Argentine Republic.”
The complainant further explained that during that period his situation was completely uncertain: “During that period my whereabouts were unknown for a long time, the competent judicial authority was not informed that it had ordered my arrest, the reasons for my arrest were not communicated, and I was kept incommunicado, without access to effective legal or consular assistance.”
Along the same lines, he maintained that during his detention he was subjected to "conditions of detention incompatible with international human rights standards, in a context that has been described as arbitrary detention without judicial guarantees”.

Legal qualification and background
The letter also notes that the situation was previously analyzed by the Argentine Justice. In this regard, it is mentioned that Chamber B of the Federal Chamber of Mendoza, within the framework of a habeas corpus, “highlighted the absence of official information regarding my procedural situation, the ignorance of the place of detention and the impossibility of accessing
effective judicial mechanisms.”
As detailed, these elements “configure a typical picture compatible with forced disappearance of a person”. It is also emphasized that these events are framed “within the framework of human rights violations that impose on the Argentine State the duty to investigate in a serious, effective and exhaustive manner
”.
Required test measures
In the same letter, Gallo requested several test measures. Among them, he asked to be summoned to give a testimonial statement “in order to provide a complete and detailed account of the events
suffered”. Nahuel Gallo.
It also required that a free letter be sent to the Federal Court of Mendoza to send a full copy of the file linked to the previously submitted habeas corpus, as well as to the UF-Mendoza, in relation to
actions initiated by forced disappearance.
The presentation was sponsored by lawyer Claudio Pedro Nuncija, and concludes with a formal request to be considered as a plaintiff in the case and to move forward with the requested measures.
In this way, the complaint promotes the judicial investigation in Argentina into the reported events, based on the serious accusations against the Venezuelan regime of Maduro, now detained in the United States after being captured in a military operation carried out by the Government of Donald Trump in early January.
