The national government warned CTERA that it must guarantee at least 75% of the educational service during the teachers' strike called for next Monday, August 3 and announced that it will apply the corresponding legal sanctions in case the union entities fail to comply with this obligation.

Through an official statement, the Ministry of Human Capital reminded that Law No. 27,802 on Labor Modernization is fully in force, which recognizes education as an essential service and limits the possibility of unions completely halting school activities.

The clarification was made jointly by the secretariats of Education and Labor, Employment and Social Security after CTERA announced a new nationwide strike action. According to the ministry led by the government, Article 101 of the legislation establishes that during union protests, a minimum coverage equivalent to 75% of the usual service must be maintained.

In this way, union organizations can carry out direct action measures, but cannot completely interrupt classes or prevent students from accessing the educational system. The provision aims to especially protect families who depend on public schools and who often become the main victims of conflicts driven by union leadership.

“The regulation ensures compliance with minimum services and the operational percentages provided for in it, preventing the total interruption of activities and safeguarding the right to learn for students at all levels,” stated Human Capital.

The Ministry also made it clear that failure to meet these percentages will not go without consequences. According to the statement, union entities that do not guarantee the established minimum service will be sanctioned through applicable legal mechanisms.

The warning marks a difference from previous administrations, which for years allowed union disputes to result in the complete suspension of classes, even when students were accumulating serious learning difficulties.

Since the administration of Javier Milei, they reaffirmed that educational continuity is a priority and emphasized that the exercise of the right to strike cannot translate into the elimination of students' right to receive education.

“The Ministry of Human Capital reaffirms its commitment to the continuity of the educational service and compliance with the legislation in force,” concluded the agency, which will seek to ensure the opening of schools.
