A journalist revealed that between the court order and the operation, an acquaintance of the former deputy removed a bag with clothing. The defense could request the annulment of the procedure

The case investigating the confusing episode involving Facundo Moyano and model Candela Arizaga has added a new chapter. One day after the events, journalist Lucas Jerez revealed on the program Arriba Argentinos a detail about the raid on the former deputy's apartment that raised strong questions about the procedure.

According to the reporter, Moyano was released under strict conditions while the investigation progresses. He has a restraining order of 300 meters from the young woman and cannot maintain any telephone contact throughout the process. The formal charges are for injuries and unlawful deprivation of liberty, framed within a context of gender violence.

The prosecutor acted ex officio, despite Arizaga denying in her statement at Hospital Pirovano that Moyano had assaulted her. That point was recorded in the file and does not change the legal framing of the case.

During the broadcast, host Nacho Otero recalled the statements made by the model's lawyer. The attorney claimed that she had not consumed substances until meeting the former deputy and that supplying drugs constitutes a crime. That assertion added another element of tension to the case.

The delay that raises doubts about the operation

The detail that caught the most attention was related to the judicial procedure carried out at Moyano's home. Jerez explained that the former deputy's defense is already anticipating that they will seek to nullify the raid, and the main reason is the time gap between the order and its execution.

The order was issued at 10 a.m. and the operation only began at 6 p.m. During that eight-hour interval, a friend of Facundo Moyano showed up at the apartment, took a fabric bag, and loaded black clothing, the same clothing the former deputy had worn when he left the Flagrancy Unit North. The journalist made it clear that it is unknown whether he only took clothing or if he removed other items.

Regarding what the Police ultimately seized, Jerez indicated that they took two cell phones, a USB drive, a smartwatch, and apparently, a syringe with a substance that, as understood, would not be a narcotic. Those items are now part of the investigation.

Nacho Otero summarized the point that, in his opinion, is most relevant: the delay between the issuance of the order and the start of the raid, with an acquaintance having time to enter the apartment and remove belongings. “The operation made little sense,” argued the host.

A central aspect of the file

That eight-hour gap has become the center of the debate and could become one of the most discussed aspects of the file. Moyano's defense is already considering filing a motion for nullity based on that temporal irregularity and the possibility that elements of interest to the case may have been altered.

Meanwhile, the former deputy remains free with the imposed restrictions. The investigation continues, and the prosecutor maintains the framing of gender violence despite Arizaga's initial statements at the hospital. The case remains open, and the details of the raid added a new layer of controversy to an episode that has generated strong media repercussions from the very beginning.

The time difference between the judicial order and the operation, combined with the presence of a third party in the apartment before the Police arrived, is the element that has most challenged those closely following the case. It will be up to the Justice to determine whether that interval affects the validity of the procedure or, on the contrary, does not alter the value of the seized evidence.
