The early release of one of the main perpetrators of the child sexual exploitation scandal in Rotherham once again shook the United Kingdom and reopened an uncomfortable debate about the functioning of the judicial system in the face of extremely serious crimes when those involved belong to “minorities”.

This is Banaras Hussain, a 44-year-old Pakistani citizen convicted in 2016 for multiple crimes, including rape, sexual assault and injury. The man had admitted his participation in a child exploitation network that for years subjected minors to systematic abuse. Despite the magnitude of the crimes, he will be released after serving just nine years of a 19-year sentence

The case is part of the Rotherham scandal, one of the most serious episodes of child abuse in Europe. An official report determined that at least 1,400 minors were victims of sexual exploitation between 1997 and 2013 in that English town. The decision to grant him parole generated an immediate political reaction. Opposition leader Robert Jenrick requested that the measure be reviewed and questioned whether a person convicted of this type of crime can return to society. The Prison Service defended the procedure, arguing that probation is granted under strict conditions and supervision. Among the restrictions imposed on Hussain is a ban on returning to Rotherham, as well as the possibility of returning to prison in case of non-compliance

British law allows even those convicted of serious sexual offences to access benefits after serving part of their sentence, considering factors such as time in pre-trial detention or behavior within the prison system.
